By using the Ataya platform (website or app), you acknowledge that you have read these terms and agree to comply with all related rules and policies, including the privacy policy.

You must be of legal age to conduct transactions and have legal capacity. You must provide accurate and up-to-date information. We use OTP verification via SMS or WhatsApp to verify your phone number. You are responsible for keeping your login details confidential and for any activity under your account.

Bid Commitment: Every bid is binding if you win the auction. Reserve/Secret Price: The seller may set a reserve price; the deal does not proceed if unmet. Auto-Extension: Time may be automatically extended in the last seconds to prevent sniping. Deposits/Security: A deposit may be required to ensure seriousness and refunded per policy. Cancellation/Stopping: We reserve the right to cancel for legal or logistical reasons. Payment and Receipt: The winner must pay within the specified period and follow pickup or delivery instructions.

Accuracy of information and images, ownership of the animal, and freedom from third-party claims. Disclosure of any material defects and provision of necessary documents. Commitment to deliver to the buyer according to the agreed description and price.

By participating in the auction, you acknowledge that you have read these terms, understood them, and fully agreed to them. The electronic records of the Ataya Platform constitute the official reference for all contract data and serve as conclusive evidence before all authorities. First: Inspection and Acknowledgment By participating in the auction, you acknowledge that you have inspected the animal during the designated inspection period prior to the start of the auction, in an inspection that removes any uncertainty. The sale is final and binding after signing the delivery receipt, and no request for return, refund, or price reduction will be accepted for any reason, whether apparent or hidden. Second: Deposit An amount equal to (20%) of the final winning bid price shall be considered a deposit, and an initial security amount must be deposited on the platform upon registration. The remaining portion of the deposit must be completed by a direct bank transfer to the auction organizer’s account before the end of the auction event. In the event of cancellation by the buyer, the full deposit shall be forfeited to the seller. In the event of cancellation by the seller without cause, the full deposit shall be refunded to the buyer. Third: Full Payment and Brokerage Commission The buyer shall pay the full sale price within (15) hours from the time the auction is awarded; otherwise, the contract shall be automatically terminated and the full deposit shall be forfeited to the seller. A brokerage commission of (7%) of the winning bid price shall be charged in favor of Qawafel Al-Sahra (the auction organizer) and added to the amount due. Fourth: Holding, Delivery, and Transportation The animal shall not be delivered until full payment of the sale price and the brokerage commission is confirmed. Holding fees of (500 SAR per day) shall apply after the expiry of the 15-hour period, and the seller shall have the right to sell the animal to recover the price and expenses. The buyer shall collect the animal within (24) hours of completing payment, and full responsibility shall transfer to the buyer immediately upon payment. Fifth: Death of the Animal Before Delivery After the auction is awarded, the animal shall be deemed the property of the buyer and at the buyer’s risk. The auction organizer shall bear responsibility for death or damage only if negligence is proven by a documented veterinary report; otherwise, the buyer shall bear full responsibility. Sixth: Contract Formation and Dispute Resolution Upon the awarding of the auction, the contract shall be deemed final and binding, and the electronic records of the Ataya Platform shall constitute conclusive evidence of all details. Dispute resolution mechanism: Amicable settlement within (7 days) Then escalation to the Ataya Platform Then the Commercial Court in Riyadh This contract shall be governed by the provisions of Islamic Sharia and the applicable laws and regulations of the Kingdom of Saudi Arabia. Participant Acknowledgment (all items must be accepted to proceed) ☐ I acknowledge that I have read and fully agreed to the auction’s terms and conditions. ☐ I acknowledge that I have inspected the animal during the designated inspection period in an inspection that removes any uncertainty. ☐ I acknowledge my obligation to pay the deposit, brokerage commission, and the full price within the prescribed time limits.
